Are verbal employment agreements valid in India?
Technically yes under the Indian Contract Act, but verbal agreements are nearly impossible to enforce. Written contracts are essential.
What happens without a proper employment contract?
Disputes over notice periods, IP ownership, confidentiality, non-compete obligations and exit terms become extremely difficult to resolve without documented agreements.
Do we need separate contracts for contractors vs employees?
Yes — and the distinction is critical. Misclassifying employees as contractors creates significant legal and tax liability.
Is the code of conduct legally binding?
Yes, when incorporated into the employment contract by reference. Documented breaches provide grounds for disciplinary action and, if necessary, termination.
Do HR policies need to be registered?
